While tobacco companies wait for a judicial verdict on the validity of an EU directive outlawing heated tobacco flavours across Europe, the ban has already come into effect, and member states may incorporate it into their legislations before that verdict is reached.
The Court of Justice of the European Union (CJEU) is currently processing a claim by tobacco companies challenging the validity of the European Commission (EC) Delegated Directive that sets a ban on all heated tobacco flavours except tobacco.
