The decision by the US Court of Appeals for the Federal Circuit to strike down many of president Donald Trump’s tariffs, invoking the International Emergency Economic Powers Act (IEEPA), could have significant – and partly unpredictable – implications for the vaping and other novel nicotine product industries.
The court held that the president lacked the constitutional authority to impose such sweeping tariffs without explicit congressional authorisation. However, the tariffs remain in place temporarily until 14th October, allowing for a possible appeal to the Supreme Court.
