An appeal on the EU heated tobacco product (HTP) flavour ban – brought by UK-based Nicoventures Trading and other British American Tobacco (BAT) subsidiaries to the Court of Justice of the European Union (CJEU) after a lower court dismissed the companies action for annulment – is also unlikely to succeed.
Nicoventures, along with BAT Italy, Poland, Spain and the tobacco giant’s Irish subsidiary PJ Carroll, had asked the CJEU’s General Court for the annulment of a European Commission (EC) directive establishing a flavour ban for HTPs across Europe.
