Puerto Rico: heated tobacco regulation, September 2022

Heated tobacco falls under the category of cigarettes and is subject to the same restrictions in Puerto Rico. Since the responsibilities of the US Food and Drug Administration (FDA) extend to Puerto Rico, we understand that new tobacco products intended to be marketed within Puerto Rico need to go through the FDA’s premarket tobacco application (PMTA) process.

No local initiatives are expected in the near future.

This report provides a complete overview of the current regulatory framework in place for heated tobacco products in Puerto Rico, covering everything from advertising and product restrictions to notification, public usage and taxation.
