South Africa: heated tobacco and herbal heated product regulation, July 2025

Heated tobacco is regulated in South Africa under the general tobacco framework, while herbal heated products are currently treated as consumer products, although there is a bill seeking to equate them to nicotine products. Although progress on the bill to introduce specific restrictions to new tobacco products – such as heated tobacco – has been slow, legislative developments are currently taking place, as the bill is proceeding in Parliament, with key discussions and debates from stakeholders currently happening. The bill has been heavily criticised by the industry and may therefore have been amended by the time it is approved.
