US: smokeless tobacco product regulation – federal packaging requirements, December 2022

Smokeless tobacco products in the US must comply with the federal packaging requirements and are subject to Food and Drug Administration (FDA) authority. In 2009, the Family Smoking Prevention and Tobacco Control Act authorised the FDA to regulate smokeless tobacco products, the definition of which includes chewing tobacco, snuff, and snus.

The FDA regulates the packaging and labelling of smokeless tobacco products, under the Comprehensive Smokeless Tobacco Health Education Act, the Federal Food, Drug, and Cosmetic Act (FD&C Act), and the FD&C Act’s implementing regulations.
