The advocate general of the Court of Justice of the European Union (CJEU) has issued a significant legal opinion supporting the European Commission’s decision to ban flavoured heated tobacco products (HTPs) across the European Union.
The case referred by the High Court of Ireland (case C-759/23) focused on whether the Commission exceeded its delegated powers under Directive 2014/40/EU when it introduced stricter rules through Delegated Directive 2022/2100, particularly banning characterising flavours in HTPs.
